USCIS Proposes 75% Increase to U.S. Citizenship Application Fees

U.S. Citizenship and Immigration Services (USCIS) has published a proposed rule that would significantly raise the cost of applying for U.S. citizenship and largely eliminate fee waivers and reduced-fee options. The rule is not yet in effect, and current fees remain unchanged for now, however if finalized, the changes would meaningfully increase the cost of naturalizing. We have been promoting what Jeff Margolis calls "IMMunization" meaning to erect more guardrails as to government encroachment on immigrant rights. You should upgrade your immigration status to the highest possible level. This means for example, if you are here on an H-1B work permit - look to get a green card and if you now have a green card - look to upgrade to U.S. citizenship. So for those who have been contemplating U.S. citizenship now would be an opportune time to move forward.

What's Being Proposed

Under the proposed rule, filing fees would increase as follows:

• Form N-400 (Application for Naturalization): from $760 to $1,330 for paper filings, and from $710 to $1,280 online.

• Form N-336 (Request for a Hearing on a Naturalization Decision): from $830 to $1,475 for paper filings, and from $780 to $1,425 online.

Why You May Want to Review Your Eligibility Now

If you are a lawful permanent resident who is eligible (or close to eligible) to apply for citizenship, this proposal is worth your attention for two reasons:

• Cost. Applications that USCIS receives before any final rule takes effect would be filed at today's lower fees. For many families, that difference is several hundred dollars or more per applicant.

• Securing your status. Beyond the cost savings, many permanent residents are choosing to pursue citizenship sooner rather than later to secure the full and lasting protections that come with becoming a U.S. citizen.
